Warren Buffet is involved in a situation in which he is deciding whether one of his employees, David Sokol, did something wrong and possibly illegal when he bought close to $10 million in Lubrizol stock prior to Buffet’s firm, Berkshire Hathaway, making an offer to buy the company. Buffet should be careful in his defense of Sokol that it wasn’t just Sokol who did something wrong here and quite possibly illegal . . . Conflicts are certain to arise when the party making the decisions to act is the party making the judgment as to whether and how to mete out punishment. Buffet cannot play both roles, even though at times he does seem to be omniscient and all powerful.

And when you describe the abhorrent behavior on Wall St, is that still going on?
Well, sure. Absolutely. Yeah. That’s the saddest thing about this whole episode. It took a major financial crisis that almost bankrupted the global financial system to make people realise that we had a very serious problem occurring in our financial system and what did we do? We raced around like Humpty Dumpty soldiers and horses trying to put the old system back together again and we put together these banks that were too big to fail. People today seem to think that just because two people want to trade something, it must be good. Because the CDS market is big, it must be useful, goes the argument. It gets at the belief system that you suggested people have adopted: that markets are inherently good. Maybe always efficient, but not always good. There are some things like company default risk that shouldn’t be traded. In the past people wanted to buy and sell slaves, child pornography, women’s bodies. . . Just because a market can develop does not mean the functioning of that market is good for society. Markets cannot self-reflect. That is what humans do. Only we can decide if a particular market is doing more harm than good.

A Democrat, Talbott objects to the Reagan-era philosophy of deregulation which he says led to this avoidable crisis. The book includes many suggestions for an overhaul, not just of market regulation, of the ratings agencies, but also of the relationship between Wall Street and Capitol Hill.
“What’s so upsetting to me is that it’s so avoidable, and that this is now going to cause real, real pain to families,” he told the Herald. He predicts real unemployment—those not working, not just those seeking work—will reach Depression levels of 25 percent. “The prime cause was not just deregulation, but the fact that the people who should have been regulated went to Congress and got what they wanted written into the laws.”—from the article
